Federal Court Mandates Freedom of Abrego Garcia from Immigration Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case originates in a erroneous deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his repatriation to the United States to answer alien smuggling charges, he was detained in federal custody.
In her decision, the court noted that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
